SCOTT H. STILES · ESTATE ADMINISTRATOR
Property needs attention before it reaches a closing table.
Real property can be an estate’s most visible asset and one of its most demanding responsibilities. Insurance, taxes, liens, condition, occupancy, title, and the authority to act all affect the administration.
As administrator, I address those issues as part of the estate’s work and coordinate with the professionals involved. A proposed sale must fit the estate’s authority and the applicable probate procedure. A sale contract alone does not settle the legal requirements for closing.
The work involved
Preservation and condition
Identify immediate property concerns, maintenance needs, insurance issues, taxes, and other matters affecting protection of the asset.
Ownership and authority
Review deeds, ownership interests, appointment documents, and title requirements with the appropriate professionals.
Occupancy and practical issues
Identify occupancy, access, possession, or condition concerns and address the lawful process appropriate to the estate.
Preparing a proposed sale
Work with real estate and title professionals on the documents and administration questions involved in a transaction.
Court procedures and proceeds
For a dependent administration, attend to applicable sale applications, orders, reports, confirmation, and handling of proceeds.
